நீதிபதிகளின் சொத்து விவரங்கள்

Why dissent is good...

ஒரு பக்கம், குடியாட்சி முறையிலான கட்சிகள் உள்ளிருந்து எழும் மாற்றுக் குரல்களைக் கண்டு கதிகலங்கி, எதிர்க்குரல் கொடுப்பவர்களைக் கட்சியில் இருந்து வெளியேற்றி வரும் நேரம், இந்திய நீதித்துறையில் ஒரு வரவேற்கத்தக்க மாற்றம் நிகழ்ந்துள்ளது.

உச்ச, உயர் நீதிமன்றங்களின் நீதிபதிகள் தங்களது சொத்து விவரங்களை வெளியிடவேண்டும் என்று நாடாளுமன்றத்தில் ஒரு சட்ட மசோதா கொண்டுவரப்பட்டு, சில டெக்னிகல் காரணங்களால் அது இயற்றப்படவில்லை. மீண்டும் அந்தச் சட்டம் மாற்றுவடிவில் கொண்டுவரப்படலாம் என்று சொல்லப்படுகிறது. Campaign for Judicial Accountability and Judicial Reforms என்ற அமைப்பு இதற்காகக் கடுமையாகப் போராடி வருகிறது. இந்த அமைப்பில் உள்ள மிகச் சிறந்த ஜூரிஸ்டுகள் பலரும் நமது நீதித்துறையில் புரையோடிப் போயிருக்கும் ஊழல்களை அகற்ற, நீதித்துறையில் சீர்திருத்தங்கள் கொண்டுவரப் போராடி வருகின்றனர்.

இதற்கிடையில் நீதிபதிகள் சொத்து விவரங்களை வெளியிடவேண்டும் என்று கூக்குரலுக்கு உச்ச நீதிமன்றத் தலைமை நீதிபதி பாலகிருஷ்ணன் ‘ஆதரவு’ தெரிவிக்கவில்லை. ஆனால், பாலகிருஷ்ணனின் கருத்துக்கு வெளிப்படையாகவே எதிர்ப்பைத் தெரிவித்த கர்நாடக உயர் நீதிமன்றத்தின் நீதிபதி ஷைலேந்திர குமார், இந்தியன் எக்ஸ்பிரஸில் கட்டுரைகள் எழுதியதோடு, தன் சொத்து விவரத்தை பகிரங்கமாக வெளியிட்டார். உச்ச, உயர் நீதிமன்ற நீதிபதிகள், தம் சொத்து விவரங்களை வெளியிட விரும்பவில்லை என்று பாலகிருஷ்ணன் சொன்னது அவரது தனிப்பட்ட கருத்தாக இருக்கலாமே தவிர, அவருக்கு பிற நீதிபதிகள் சார்பாகப் பேச எந்த உரிமையும் இல்லை என்று ஷைலேந்திர குமார் ஆணித்தரமாகச் சொன்னார்.
On the legal plane, the Chief Justice of India does not have the authority to speak for all other judges of the superior courts, whether of the Supreme Court or of high courts, unless any of them have either confided in the chief justice or have authorised him to speak on behalf of others also.
இதனால் சற்றே கோபம்கொண்ட உச்ச நீதிமன்றத் தலைமை நீதிபதி, ஷைலேந்திர குமார் பிரபலமாக ஆசைப்பட்டு இப்படி ஒரு கருத்தை வெளியிட்டுள்ளார் என்று ‘சின்னப்பிள்ளைத்தனமான’ ஒரு கருத்தை வெளியிட்டார். ஆனால், அடுத்த ஓரிரு நாள்களுக்குள்ளாக உச்ச நீதிமன்ற நீதிபதிகள் அனைவரும் ஒரு கூட்டம் போட்டு தங்களது சொத்து விவரங்களை வெளியிடுவது என்று முடிவு செய்துள்ளனர்.

ஷைலேந்திர குமார் ஒரு மாற்றுக் கருத்தை பகிரங்கமாக வெளியிட்டு, அதனால் வரும் பின்விளைவுகளைப் பற்றிக் கவலைப்படாத காரணத்தால்தான், பிற நீதிபதிகள் ஒருவித அழுத்தத்துக்கு ஆளாகி இந்தத் தகவல்களை வெளியிட ஒப்புக்கொண்டுள்ளனர். இதுதான் எதிர்க்குரலில் பலம். (ஷைலேந்திர குமாருக்கு முன்னதாக, பஞ்சாப், ஹரியானா உயர் நீதிமன்றத்தின் நீதிபதி கண்ணன் தன் சொத்து குறித்த தகவல்களை வெளியிட்டார்.)

நீதிபதிகள் சொத்து விவரங்களை வெளியிட்டால் நீதித்துறையில் ஊழல்கள் போய்விடுமா என்று கேட்கலாம். ஆனால் இது முதல் படிதான். எப்படி இன்று எம்.எல்.ஏ, எம்.பி கோஷ்டிகளில் சொத்து விவரங்கள் நமக்குத் தெரிகிறதோ அதேபோல நீதிபதிகளின் சொத்தும் வெறும் ஒரு விவரமே. ஆனால் அந்த விவரத்தை எடுத்துக்கொண்டு பொதுமக்கள் என்ன கருத்துகளை உருவாக்கிக்கொள்கிறார்கள், என்ன முடிவுகளை எடுக்கப்போகிறார்கள் என்பது இனிவரும் ஆண்டுகளில்தான் தெரியவரும்.

பணக்காரர் ஒருவரை தேர்ந்தெடுப்பதில் தவறில்லை. ஆனால் தேர்ந்தெடுக்கப்பட்ட ஏழைகள் அனைவரும் ஐந்து வருடம் தாண்டியதும் எப்படி கோடிக்கணக்கான சொத்துகளை உருவாக்கிக்கொள்கிறார்கள் என்ற தகவல் மக்களுக்குக் கிடைக்கும்போது மக்கள் கட்சிகளுக்கும் வேட்பாளர்களுக்கும் நல்ல பாடம் புகட்டலாம். மாற்றுகள் முன்வைக்கப்படலாம். ஆனால் அனைத்துக்கும் முதலாவதாகத் தேவை தகவல்கள். இப்போதைய போராட்டமே, தகவல்கள் தடங்கல்கள் இன்றி வெளியே வரவேண்டும் என்பதே.

ஷைலேந்திர குமார் பிரபலமாகிவிட்டார். நியாயமாகவே.

  3. May be All Income Tax guys need to provide it.
    Custom guys, IAS, IPS, etc...

    may be they are already filing taxes, Add a section to list all the movable and immovable properties, that should do it.

    One more option, when they join any state or central govt job, they should provide the property details along with the family.


    one good thing,when you force the top, they grudgingly force the bottom guys and other top guys.

    may be one day, we are all working with white money (atleast forced to)

  5. I am surprised that you too have joined the populist chorus of calls for the disclosure of income/assets of judges. It is a slippery slope in the short road to loss of privacy and mis/abuse of personal information. And very telling of a society which seems to think public disclosure of wealth information of private individuals is the best deterrent against corruption in high offices.

  6. I think privacy has to take a back seat here. The rampant corruption by people in high offices is in no way checked by the existing government machinery. They do not have the interest or desire to root out corruption. It is in such a scenario that, in order to restore confidence in certain institutions, we need to call for this data.

    I do not believe that this is sufficient to root out corruption at this stage. When I see the asset/income declaration from every MLA/MP, I am quite shocked, because except in very few cases, I do not believe that it could have been obtained through legal means. It will help me to make a better decision going forward. Similarly people in all key govt. posts - the judges, the collectors, all the IAS officers need to declare their income/asset, so we can find out for ourselves how they actually earn this, and whether they abuse their privileges.
